Consignor Agreement

This Consignor Agreement applies to all consignment events operated by Cola Kids Consignment, LLC, including the Cola Kids Consignment Sale and the Cola Grown-Ups Sale.

By registering as a consignor for either sale, you acknowledge that you have read, understood, and agree to be bound by this Consignor Agreement, as well as all published consignor policies, procedures, accepted item guidelines, prohibited item lists, seasonal guidelines, and deadlines applicable to the sale in which you are participating.

A non-refundable consignor registration fee is required for each sale.

Registration remains open until either:

• The maximum number of consignors has been reached, or 
• Registration closes for the current sale. 

Consignors receive 65% of the selling price of each item sold.

Depending on the volunteer level completed, consignors can earn up to 80% of their total sales.

Volunteers must complete all assigned shifts and responsibilities to receive the increased payout.

Payments will be distributed during the designated consignor pick-up whenever possible.

If payments are unavailable at pick-up, they will be mailed within approximately two weeks.

Checks must be deposited or cashed within sixty (60) days of the consignor pick-up date for the applicable sale. A $35 processing fee will apply to replacement checks. Checks will not be reissued after the sixty (60) day period.

Any questions regarding payments, missing checks, or payment discrepancies must be submitted in writing within seven (7) days of the consignor pick-up date for the applicable sale. After this timeframe, no payment claims or discrepancies will be considered.

By consigning, you certify that:

• You are the legal owner of all items submitted. 
• You have the legal authority to sell those items. 
• Your items are free of liens or ownership disputes. 

All items must be:

• Clean 
• Odor free 
• Complete 
• In excellent working condition 
• Free of stains, tears, holes, excessive wear, broken parts, or missing pieces 

Items requiring batteries must contain fresh working batteries.

Cola Kids Consignment, LLC reserves the right to refuse or remove any item that does not meet sale standards.

Consignors are solely responsible for ensuring their items comply with all applicable safety standards.

For children's items, consignors are responsible for verifying that items have not been recalled by the manufacturer before consigning.

Cola Kids Consignment, LLC assumes no responsibility for recalled products submitted by consignors.

Each sale maintains its own list of accepted items, prohibited items, seasonal guidelines, and item limits.

Consignors agree to follow all published guidelines for the specific sale in which they are participating.

Cola Kids Consignment, LLC reserves the right to remove any item that does not comply with these guidelines.

Consignors determine the selling price of their own merchandise.

By submitting items, consignors authorize Cola Kids Consignment, LLC to sell their merchandise at the barcode price entered into the consignor system.

Altered, handwritten, or modified tags will not be honored.

Items selected by the consignor to participate in discount sales will automatically be discounted according to the published sale schedule.

Items designated for donation may automatically participate in the final discount sale.

Consignors are strongly encouraged to place their consignor number on masking tape inside or securely attached to every item.

If a tag becomes detached, Cola Kids Consignment, LLC reserves the right to identify, re-price, and sell the item whenever possible.

While every reasonable effort is made to safeguard consignor merchandise, consignors understand and agree that they consign items at their own risk.

Cola Kids Consignment, LLC shall not be responsible for items that are:

• Lost 
• Stolen 
• Broken 
• Damaged 
• Misplaced 
• Separated from matching pieces 
• Destroyed due to weather, fire, flooding, theft, or any other unforeseen circumstance 

Consignors should not submit items that are irreplaceable or of significant sentimental value.

To protect shoppers, Cola Kids Consignment, LLC reserves the right to issue refunds for merchandise determined to be:

• Unsafe 
• Broken 
• Missing parts 
• Not functioning properly 
• Misrepresented 

Returned merchandise may be removed from the consignor's sales totals.

Items designated by the consignor for donation that remain unsold will be donated to one of our charitable partners.

Items not picked up during the designated consignor pick-up period will also become the property of Cola Kids Consignment, LLC and may be donated.

Unsold items not marked for donation must be picked up during the published consignor pick-up time for the current sale.

Items left after the designated pick-up period will be considered abandoned and donated.

No exceptions.

Consignors may authorize another individual to pick up their merchandise.

By doing so, the consignor waives the right to report missing merchandise after pick-up has been completed.

Questions regarding:

• Missing items 
• Payments 
• Checks 
• Sales discrepancies 

must be submitted by the published deadline for the applicable sale.

Claims submitted after that deadline cannot be honored.

By participating in a Cola Kids Consignment, LLC event, consignors grant permission for photographs or videos of their merchandise to be used in advertising, marketing, social media, and promotional materials without compensation.

Cola Kids Consignment, LLC reserves the right to refuse service, remove merchandise, suspend consignor privileges, or deny future participation if a consignor repeatedly violates sale policies or submits merchandise that does not meet sale standards.

Cola Kids Consignment, LLC reserves the right to modify policies, procedures, accepted item lists, prohibited item lists, sale schedules, volunteer requirements, deadlines, and other operational guidelines at any time.

Current policies published on the official website shall govern participation.

By registering as a consignor for the Cola Kids Consignment Sale or the Cola Grown-Ups Sale, you acknowledge that you have read, understood, and agree to this Consignor Agreement, all published sale policies, and all sale-specific guidelines. Registration constitutes your electronic acceptance of these terms.
